Q: We recently found a home for sale we wanted to see the inside of. I called the listing agent info (Realtor A) on the sign and he let us inside the house. He asked if we had a realtor and we said no ? said to email him and he would give us the neighborhood comps. I did email him and he emailed back the comps and also said if we wanted to make an offer that someone else in his office could write up the contract to ensure both sides were fairly represented. Realtor B called and showed us the house one more time. We decided to make and offer. He didn?t want to spend time writing up a contract because he didn?t think they would take our offer, so he called and presented the offer verbally to Realtor A. Sellers verbally counter-offered and in the end nothing happened because we were a little too far apart (<$5k) on a $300k house. No contract was ever written, we never signed anything with "our" realtor. In a few months, if the house is still on the market, can we submit a written offer on the house without Agent B? We believe we can negotiate a lower buyers commission with another realtor to put the house under contract at the numbers presented that both parties would accept. Do we owe Realtor A or B anything if we do so?

A: Check with a TX Real Estate Atty; if legally off the hook, let the Realtor know so he/she stops contacting you. If his/her service benefited you, throw a referral their way or recommend them to a friend. We spend lots advertizing, any satisfied customer contributes to our goals. JC

Realtor A was what is referred to as procuring cause and provided you with everything you needed to make a decision to make an offer on the home. Realtor B was provided to you by Realtor A as an in-house designated buyer?s broker.
The buyer does not negotiate a buyer?s commission as it comes through an offer of cooperation through the listing broker via the Multiple Listing Service.
All offers, however, are to be in writing. I suggest you meet with Realtor A or B and submit an offer in writing.
